NOTICE OF RATIFICATION VOTE


NOTICE OF RATIFICATION VOTE VOTING DATE: AUGUST 13, 2019 TO: ALL MEMBERS OF MISSANABIE CREE FIRST NATION

TAKE NOTICE that a Ratification Vote will be held on August 13, 2019, to determine whether the Eligible Voters of Missanabie Cree First Nation agree to the terms of the Missanabie Cree First Nation Treaty Land Entitlement Settlement Agreement between Her Majesty the Queen in Right of Canada and Missanabie Cree First Nation (the “Settlement Agreement”) and the Missanabie Cree First Nation Legacy Trust (the “Trust Agreement”).

The Ratification Vote will take place on August 13, 2019 at the Multipurpose Facility at Missanabie during the Annual Gathering from 1:00 PM to 6:00 PM.

Eligible Voters

For the purposes of the Ratification Vote, Eligible Voters are those members of Missanabie Cree First Nation who, on August 13, 2019, is 18 years of age or older, is registered on the Band List, and is not disqualified from voting at Band elections.

Eligible Voters may vote only once in-person at the polling station, or through electronic voting. A Voters List is included with this Notice. Sections 3.3, 3.4, and 3.5 of the Voting Guidelines provide:

3.3 On request, the Ratification Officer shall confirm whether the name of a person is on the Voters List.

3.4 The Ratification Officer may revise the Voters List where it is demonstrated that:

a)the name of a person has been omitted from the Voters List;

b)the name of a person is incorrectly set out in the Voters List; or

c) the name of a person not qualified to vote is included in the Voters List.

3.5 For the purposes of section 3.4, a person may demonstrate:

a) that the name of a person has been omitted from, or incorrectly set out in, the Voters List by presenting to the Ratification Officer evidence that the person is a Voter; or

b) that the name of a person not qualified to vote has been included in the Voters List by presenting to the Ratification Officer evidence that the person is not a Voter.

Application for a change to the List of Eligible Voters should be made to Vaughn Johnston, the Ratification Officer (see contact information below).

Information Packages

Our lawyers have prepared an Information Package for membership which includes an explanation of the Settlement Agreement, an explanation of the Trust Agreement, information about the history of the claim, and answers to frequently asked questions. Copies of the Information Package can be obtained at no cost to you from Vaughn Johnston, Ratification Officer. Information about Per Capita Distributions (“PCD”) will be provided to all Missanabie Cree First Nation Members as soon as possible and in advance of the Ratification Vote.

Ballot Question

The following two-part “yes or no” question will be asked by secret ballot of Eligible Voters of Missanabie Cree First Nation:

As a Voter of the First Nation, do you:

a) agree to all of the terms and conditions of the Missanabie Cree First Nation Treaty Land Entitlement Claim Settlement Agreement initialed by the negotiators for the First Nation and Canada, which settles and releases Canada from the Missanabie Cree First Nation Treaty Land Entitlement Claim and the Trust Agreement;

and

b) authorize and direct the Council of the First Nation to sign all documents and do everything necessary to give effect to the Missanabie Cree First Nation Treaty Land Entitlement Claim Settlement Agreement and the Trust Agreement?
